CONSUMER HEALTH DATA PRIVACY POLICY

The Skin Therapy Edit respects the privacy of our customers and is committed to protecting information you choose to provide about your skin, skincare concerns, preferences, and goals.

This Consumer Health Data Privacy Policy explains how The Skin Therapy Edit (“The Skin Therapy Edit,” “we,” “us,” or “our”) collects, uses, protects, and handles consumer health data and describes rights that may be available under the Washington My Health My Data Act (“MHMDA”), Chapter 19.373 RCW.

This policy applies specifically to consumer health data. It is separate from our general Privacy Policy, which addresses other personal information associated with activities such as purchases, payments, customer accounts, shipping, website usage, and communications.

1. OUR PRIVACY COMMITMENT

The Skin Therapy Edit uses information about your skin for the purpose you provided it: to help provide personalized skincare guidance, product recommendations, and services you request from us.

We do not sell consumer health data.

We do not share customers’ skincare questionnaire responses, skin concerns, personalized routine information, or other consumer health data with third parties for their own advertising, marketing, data-broker, or independent commercial purposes.

We do not use information about your skin to provide medical diagnoses.

When technology providers process information on our behalf solely as necessary to operate our website or provide a service you requested, we seek to limit that processing to what is reasonably necessary for that purpose.

2. CONSUMER HEALTH DATA WE MAY COLLECT

When you voluntarily use our Build My Routine experience, request skincare guidance, communicate with us regarding your skin, or otherwise provide information about your skincare needs, we may collect information that could be considered consumer health data under Washington law.

Depending upon what you choose to provide, this may include information concerning:

  • Acne or breakouts
  • Dryness or dehydration
  • Oiliness or excess oil production
  • Redness
  • Skin sensitivity or reactivity
  • Hyperpigmentation, discoloration, or uneven skin tone
  • Fine lines, wrinkles, firmness, or other visible signs of aging
  • Skin barrier concerns
  • Post-procedure or recovery-related skincare needs
  • Your experience or tolerance with active or corrective skincare products
  • Product sensitivities or reactions you voluntarily disclose
  • Ingredients or product types you indicate you wish to avoid
  • Your current skincare routine or products, if you choose to provide that information
  • Your skincare goals and preferences
  • Other skin-related concerns you voluntarily disclose

We may also use your responses to determine which general skincare category or products may be appropriate for the concerns you identify.

For example, if you tell us that your skin is dry and sensitive, we may use those responses to prioritize products intended for hydration and barrier support while avoiding products that may be less appropriate for the preferences and concerns you identified.

We seek to collect only information reasonably relevant to providing the skincare experience or service you request.

3. SOURCES OF CONSUMER HEALTH DATA

The consumer health data covered by this policy is primarily collected directly from you.

Sources may include:

  • Responses you voluntarily provide through Build My Routine
  • Skincare questionnaires
  • Requests for skincare recommendations
  • Communications you initiate with The Skin Therapy Edit
  • Customer-service communications regarding your skincare routine or products
  • Information you voluntarily provide when requesting professional skincare guidance

We do not intentionally obtain medical records from physicians, hospitals, health insurers, pharmacies, or other healthcare providers through our Build My Routine experience.

4. HOW WE USE CONSUMER HEALTH DATA

We use consumer health data only for purposes disclosed in this policy or otherwise permitted by applicable law.

These purposes may include:

  • Providing the Build My Routine experience you request
  • Understanding the skincare concerns and preferences you identify
  • Generating personalized skincare product recommendations
  • Creating a suggested morning and/or evening skincare routine
  • Identifying products that correspond with your stated skin concerns
  • Accounting for sensitivity or reactivity you identify
  • Avoiding unnecessary or potentially redundant skincare products
  • Considering your stated skincare goals and preferences when generating recommendations
  • Considering your stated budget when selecting among appropriate products
  • Determining when professional esthetician review may be beneficial before selecting certain corrective or acne-focused products
  • Answering questions you ask about your recommended skincare routine
  • Providing customer support relating to your recommendations
  • Maintaining the security and integrity of our Services
  • Complying with applicable legal obligations

We do not use your consumer health data for unrelated advertising or data-broker purposes.

Washington law generally permits collection of consumer health data with the consumer’s consent for a specified purpose or to the extent necessary to provide a product or service the consumer requested.

5. BUILD MY ROUTINE

Our Build My Routine experience uses the answers you voluntarily provide to identify skincare products that may correspond with your stated concerns, goals, sensitivity, preferences, and other selections.

For example, your responses may cause the routine builder to prioritize skincare intended for hydration and barrier support, acne and breakout concerns, visible pigmentation and uneven tone, sensitive or reactive skin, visible signs of aging or firmness concerns, calming and redness support, post-procedure skincare support, or other cosmetic skincare goals.

The purpose of collecting this information is to provide the personalized skincare experience you requested by using Build My Routine.

Build My Routine provides cosmetic skincare education and product recommendations. It does not provide medical diagnoses, medical treatment plans, or medical advice.

6. WE DO NOT SELL CONSUMER HEALTH DATA

The Skin Therapy Edit does not sell consumer health data.

We do not sell information concerning your skin concerns, questionnaire responses, skincare routine, sensitivities, or personalized recommendations to data brokers, advertisers, marketing companies, or other third parties.

We do not exchange this information for monetary or other valuable consideration in a manner constituting a sale under the Washington My Health My Data Act.

7. WE DO NOT SHARE CONSUMER HEALTH DATA FOR THIRD-PARTY MARKETING

The Skin Therapy Edit does not share consumer health data with third parties for their own marketing, advertising, profiling, or independent commercial purposes.

This includes the substance of information you provide concerning acne or breakouts, sensitivity, pigmentation, aging concerns, redness, skin barrier concerns, product reactions, personalized skincare recommendations, and Build My Routine questionnaire responses.

We do not intentionally provide this information to advertising networks or data brokers for their independent use.

8. SERVICE PROVIDERS AND PROCESSORS

Like most online businesses, The Skin Therapy Edit uses technology providers to operate its website and online store.

Our storefront uses Shopify technology.

Technology providers acting on our behalf may process information only where necessary to provide website functionality, securely transmit or store information, provide the personalized functionality you requested, maintain our Services, or perform other services on our behalf.

These providers are not authorized by The Skin Therapy Edit to use consumer health data for their own independent marketing or advertising purposes.

Under Washington’s My Health My Data Act, providing consumer health data to a processor in order to provide goods or services consistently with the purpose for which the information was collected is excluded from the Act’s definition of “sharing.” Washington also imposes specific contractual and processing requirements on processors handling consumer health data on behalf of covered businesses.

9. ADVERTISING

The Skin Therapy Edit does not intentionally use the substance of your Build My Routine responses or other consumer health data for third-party targeted advertising.

We do not intentionally provide your individual skin concerns, questionnaire answers, sensitivities, or personalized routine information to advertising companies so they can advertise to you based upon those health-related characteristics.

Our website may use ordinary e-commerce technologies, cookies, or analytics as described in our general Privacy Policy.

10. YOUR CONSUMER HEALTH DATA RIGHTS

Depending upon applicable law, you may have the right to confirm whether The Skin Therapy Edit is collecting, sharing, or selling consumer health data concerning you; access consumer health data concerning you; obtain information regarding consumer health data we collect; request deletion; withdraw consent to future collection or sharing where applicable; receive information regarding parties with whom consumer health data has been shared or sold, where applicable; and appeal a refusal to act upon an eligible request.

We will not unlawfully discriminate against you for exercising rights provided by applicable privacy law.

Please describe the right you wish to exercise and provide enough information for us to reasonably identify the interaction or information associated with your request. You are not required to create a new customer account solely to submit a privacy request. We may take reasonable steps permitted by law to authenticate your identity before providing access to or deleting consumer health data.

12. DELETION REQUESTS

You may request deletion of consumer health data concerning you as provided by applicable law.

When an eligible deletion request is received and authenticated, we will delete the applicable consumer health data from our records as required by law and communicate the request to applicable processors or other parties where required.

Certain information may be retained where retention is permitted or required by law, including when reasonably necessary for security, fraud prevention, legal compliance, or the establishment, exercise, or defense of legal claims.

13. WITHDRAWING CONSENT

Where our collection of consumer health data relies upon your consent, you may withdraw that consent for future collection by contacting us using the information above.

Withdrawal does not necessarily affect processing that lawfully occurred before the withdrawal. If information is necessary to provide a personalized service you request, withdrawing consent or requesting deletion may mean we can no longer provide or reproduce that personalized service.

14. APPEALS

If we decline to take action on an eligible consumer health data request, you may appeal our decision.

We will review and respond to eligible appeals in accordance with applicable law.

15. DATA SECURITY

We take reasonable administrative, technical, and physical measures appropriate to the nature and volume of information we process to protect consumer health data.

We seek to limit access to consumer health data to persons and service providers for whom access is reasonably necessary to provide the requested service or fulfill the purposes described in this policy.

Washington law requires covered businesses to restrict access to consumer health data and maintain administrative, technical, and physical safeguards appropriate to the nature and volume of the information.

No electronic transmission or storage method can be guaranteed to be completely secure.

16. DATA MINIMIZATION

Please provide only the information reasonably necessary for the skincare service you are requesting.

Unless specifically requested for a particular service, please do not provide medical records, health insurance information, Social Security numbers, detailed medical histories, prescription records, or information unrelated to your skincare request.

If you have a medical skin condition or need medical advice, please consult an appropriately qualified healthcare professional rather than submitting detailed medical information through Build My Routine.

17. CHILDREN

Our personalized skincare tools are not intended to knowingly collect consumer health data from children in circumstances prohibited by applicable law.

A parent or legal guardian who believes that a child has inappropriately provided consumer health data to us may contact us using the information provided in this policy.

18. CHANGES TO THIS POLICY

We may update this Consumer Health Data Privacy Policy when our practices, Services, technology, or applicable laws change.

We will not collect, use, or share additional categories of consumer health data or use consumer health data for materially different purposes without providing disclosures and obtaining consent where required by applicable law.
